Terms of Service

Welcome to Contactwho. These Terms of Service (“Terms”) govern your access to and use of the Contactwho platform, website, and services (collectively, the “Service”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms, together with our Privacy Policy and Acceptable Use Policy. These documents form the entire agreement between you and Contactwho regarding the Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using Contactwho you represent that you meet these requirements. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Account Registration

To use the Service you must create an account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. Contactwho reserves the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans & Billing

Contactwho offers the following paid subscription plans:

  • Solo — $29/month ($24/month billed annually). 30 search credits and 15 enrichment credits per month.
  • Growth — $79/month ($66/month billed annually). 150 search credits and 75 enrichment credits per month.
  • Scale — $199/month ($166/month billed annually). 500 search credits and 250 enrichment credits per month.

New users receive a 14-day free trial with limited credits. No payment information is required during the trial. You may choose either monthly or annual billing. Annual plans are billed upfront for 12 months. Subscriptions renew automatically unless cancelled before the end of the billing period. All prices are in US dollars and exclude applicable taxes.

5. Credits & Usage

Search credits and enrichment credits are allocated monthly according to your plan. Each contact search consumes one search credit; each contact enrichment consumes one enrichment credit. Unused credits roll over for as long as your subscription is active. Upon cancellation, remaining credits are available until the end of your current billing period and are then forfeited. Credits have no cash value and are non-transferable.

6. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy. You agree not to misuse the Service, including but not limited to scraping, automated access beyond authorised API use, reselling data, or using the Service for unlawful purposes. Violation may result in immediate suspension or termination.

7. Intellectual Property

The Service, including its design, software, text, graphics, logos, and other content, is owned by Contactwho and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service. You retain ownership of any data you submit but grant Contactwho a limited licence to use it for operating and improving the Service.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service you consent to the practices described therein.

9. Third-Party Services

Contactwho integrates with third-party services to deliver the Service, including:

  • Google — authentication via “Sign in with Google” (OAuth 2.0). Subject to Google's Terms of Service and Privacy Policy.
  • Stripe — payment processing for subscriptions and billing. Subject to Stripe's Terms of Service.
  • Coresignal — professional contact and company data provider.
  • OpenAI — AI-powered features, including the Contactwho AI assistant.
  • Supabase — authentication and database infrastructure.
  • Vercel — hosting and content delivery.

These services have their own terms and privacy policies. Contactwho is not responsible for their practices or availability.

10. Third-Party Data Disclaimer

Contact and company data available through the Service is obtained from Coresignal and other licensed third-party data sources. Contactwho does not own, generate, or independently verify this data.

  • Third-party data is provided on an “as-is” and “as-available” basis. Contactwho makes no warranties or representations regarding its accuracy, completeness, timeliness, or fitness for any particular purpose.
  • Contactwho is not affiliated with, endorsed by, or associated with any company or individual whose information appears in the Service. The appearance of any company name, logo, or employee data does not imply a partnership, sponsorship, or endorsement.
  • Contactwho shall not be liable for any claims, damages, or losses arising from the use of or reliance on third-party data, including but not limited to claims by data subjects, their employers, or any other third party.
  • You are solely responsible for how you use data obtained through the Service, including ensuring compliance with all applicable data protection, privacy, and anti-spam laws.

11. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control. We are not liable for any loss resulting from downtime.

12. Limitation of Liability

To the maximum extent permitted by law, Contactwho and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service, including any claims relating to the accuracy, completeness, or legality of third-party contact data made available through the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to Contactwho in the twelve (12) months preceding the claim. The Service, including all third-party data, is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

13. Indemnification

You agree to indemnify, defend, and hold harmless Contactwho and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any rights of a third party, or any claims by third parties relating to your use of contact data obtained through the Service.

14. Termination

You may cancel your subscription at any time by contacting support.Contactwho may suspend or terminate your account if you breach these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, indemnification, and limitation of liability) will continue to apply.

15. Dispute Resolution

If a dispute arises, you agree to first attempt to resolve it informally by contacting us at support@contactwho.com. If the dispute is not resolved within thirty (30) days, either party may pursue formal proceedings. You agree that any legal action shall be brought exclusively in the courts specified under the Governing Law section below.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction of the courts of England and Wales.

17. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
